Define Rule 26 cases....what are they?

"How does someone determine the appropriate background of an expert"?

The "expert" should be very forthcoming in providing material that justifies opinions they offer relative to the case.

In being a background "detective", it is important to carefully review all of the documentation provided by the "expert".

In most instances, opposing attorneys want to view EVERYTHING the expert has spoken or written about.

"Rule 26" pertains to the Federal Supreme Court's Rules of Civil Procedure. To simplify, the Rule requires that an expert
has to divulge to the opposing party any materials previously authored by the expert. In addition, the expert must list all instances where he or she has been asked to testify either in open court or at a deposition concerning similar matters.
